Welcome to Gem Hunters, operated by DBH Digital LLC ("we", "us", or "our"). Our services are accessible through our website at https://www.gemhunters.co/ ("Website") and the official Gem Hunters Discord Server (collectively, the "Platform"). DBH Digital LLC is registered at 151 Calle de San Francisco, STE 200, San Juan, PR 00901.

1. ACCEPTANCE OF TERMS

By accessing and using the Platform for its services (“Services”), you acknowledge that you have read, understood, and agree to be fully bound by these Terms, as well as our Privacy Policy, which is incorporated by reference.

2. ABOUT US

Gem Hunters, operated by DBH Digital LLC, offers a crypto education platform featuring a Discord community, live streams, reports, guidelines, and analyst insights. We provide educational and entertainment services only, and our content should never be construed as financial advice.

3. REGISTRATION

To access the Services on the Platform, you are required to create an account by providing true and accurate personal information. As part of our Services, you will be added to our Discord Server, and your participation requires the use of your Discord user ID. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. PROVISION OF SERVICES

You must be above 18 years of age (if younger than 18 years of age please access the Platform under the supervision of a parent/guardian), and in any case not below 13 years of age, to register on the Platform and apply in order to access and use the Services. Further, the Company reserves the right, without prior notice and at its sole discretion, to restrict access to or use of certain Services (or any features within the Services).

3.1 In case you avail Services while accessing the Platform, that may be supported and/or provided by third party service provider(s), for all such services the Company disclaims all liability for any claims that may arise pursuant to your use of services provided by such third party service provider(s).

3.2 You agree and confirm that any Services provided to you by the Company are on best efforts basis and the Company may engage services of third party service provider(s) to facilitate such Services to you. We shall not in any manner be liable to you for failure or delay in providing the Services or for any temporary disablement, permanent discontinuance of the Services by us or for any consequences resulting from such actions or reasons that are beyond our reasonable control.

Our Services shall not be provided to any Office of Foreign Assets Control (OFAC) sanctioned countries pursuant to US laws and those of other applicable countries.

5. INTELLECTUAL PROPERTY

All content, reports, logos, and materials on the Platform, including but not limited to text, graphics, videos, software, and the arrangement thereof, are the property of the Company and are protected by applicable intellectual property laws. You may only use reports, live sessions, and discussions on the Platform for personal, non-commercial educational purposes and may not reproduce, modify, distribute, or display any of the content without our prior express written consent.

6. USER CONTENT

You may be able to submit, upload, or post content, including comments and reviews, related to reports or live sessions and discussions hosted by us on the Platform. By doing so, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your content in connection with the Platform and its promotion.

7. PAYMENTS AND REFUNDS

Membership fees, as specified on the Platform, must be paid in cryptocurrency. We directly receive cryptocurrency payments or facilitate them through a trusted third-party cryptocurrency payment provider. While the Company ensures a secure transaction environment, we are not liable for issues arising from the cryptocurrency payment process managed by third-party providers.

We offer a 48-hour refund policy from the moment you join the community. If you wish to request a refund within this timeframe, please contact us at [email protected]. Refunds will be processed manually, and the platform is not responsible for transaction fees (gas fees). The refund amount will match the amount of the original transaction, irrespective of any value changes.

8. TERMINATION

We reserve the right to terminate or suspend your access to the Platform at our sole discretion, without notice, for any or no reason, including, but not limited to, a breach of Clause 9 (User Code of Conduct) of the Terms. In the event of such termination, we do not provide refunds for any payments made. Termination of access will not entitle you to any refund.

9. USER CODE OF CONDUCT

You shall not display, upload, publish, or share any information which:

9.1 promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;
9.2 is patently offensive to the online community of the Platform;
9.3 harasses or advocates harassment of any member(s) of the Platform;
9.4 belongs to another person and to which you do not have any rights;
9.5 involves the unauthorized sharing, distribution, or dissemination of reports, screenshots, downloads, recordings, or any other materials or content originating from the Platform to individuals or entities outside of Gem Hunters;
9.6 attempts to use the community for pump-and-dump schemes;
9.7 seeks to steal from the community or impersonate another individual; or
9.8 involves advertising, self-promotion, or sharing of referral links or server invites without prior approval.

10. INDEPENDENT CONTRACTORS

All educators, analysts, and contributors are independent contractors, not employees of DBH Digital LLC. Contractors are strictly prohibited from providing financial advice or guaranteeing investment returns. Any statements, opinions, or recommendations made by these contractors are their own and do not reflect the views or opinions of DBH Digital LLC.

11. CHANGES TO TERMS

We may modify these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for changes if any. By continuing to use the Platform after any modifications, you agree to be bound by the revised Terms.

12. DISCLAIMER

Reports, post, and Live streams are provided for informational/educational purposes only and do not constitute professional advice. We do not guarantee the accuracy, completeness, or suitability of any reports or any information displayed in the Platform. Your use of the Platform is at your own risk.

Cryptocurrencies are highly volatile. Users acknowledge the risks associated with crypto markets and agree that the platform is not responsible for any financial losses.

We are not responsible for losses caused by malicious actors. Users should validate communication channels and avoid connecting wallets to unverified contracts.

Users should exercise caution when engaging with external links shared within the community. The platform is not responsible for the content or risks associated with third-party sites.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other tangible or intangible losses, resulting from: (a) your access to or use of, or inability to access or use of, the Services; (b) any conduct or content of any party (including, those stemming from third-party impersonators, scams, hackings, etc.) other than the Company, including without limitation, any defamatory, offensive, or illegal conduct; or (c) unauthorized access, use, or alteration of your content or information

14. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico. Any legal action or proceeding arising out of or related to these Terms, will be submitted to the personal jurisdiction of and the exclusive venue of the courts located in the Commonwealth of Puerto Rico. Any disputes will first be addressed through mediation, and if unresolved, will proceed to binding arbitration in Puerto Rico. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA).
